Many times one spouse attempts to obtain part ownership in a family business or have a business assessed at an inflated value and demand cash equivalent for his or her share of the business.

In many cases, however, a business that was part of one spouse’s personal assets before the marriage can remain separate property, with only the appreciated value subject to division during divorce. In addition, if the business owner can prove that the other spouse played little or no role in increasing the value of the business venture, the entire value may remain classified as separate property and not subject to equitable distribution.
